-What is a land trust and what does it do?

A land trust is a revocable contract between two or more parties. The first party is the owner of the property - the grantor. He grants, or transfers title of the property to the trustee of the land trust. The owner (i.e. grantor) then becomes the trust's beneficiary - along with any other co-owners that may exist. 

The beneficiaries of the land trust retain management, control and the right to receive profits from the property. They can transfer beneficial ownership to another quickly - without a deed change. And they can revoke or cancel the trust agreement at any time - which is not considered a taxable event.

Receiving the Tapu or Title Deeds

Any foreigner can purchase property in Turkey as long as the property is not located within restricted military zones. This check must always be done first, as you will not be able to purchase any property without military permission. There is no way around this official requirement, so be sure to leave several extra months of time to allow for it.

When you purchase your holiday property in Turkey you will receive a "Tapu", which means "Title Deed" in Turkish. This is the official document that states your ownership of the property.

To obtain the Tapu you will need to request it at the Land Registry Office. The office will send the application and all of the corresponding data to the military headquarters so that it can be approved. Waiting for this application to be approved and returned can take a couple months.

More than once, a commissioner or judge has ruled a third-party cannot be examined - even if they own a property with the judgment debtor, and raised three children with them.

When a couple refers to themselves as husband and wife, have raised kids to adulthood, and purchased a house together, the wife can keep her maiden name for her drivers license, and claim she is not liable for the husband's debts.
