In this article we will try to answer a controversial question: at what moment does a person becomes protected under the Human Rights Law. In Canada the answer can be found in three cases: R. v. Sullivan in 1991, Borowski v. Canada (Attorney General) in1989, Tremblay v. Daigle in 1989. In 1989 Joseph Borowski a pro-life activist who was against abortions challenged the abortion provisions under section 251 of the Criminal Code as violations of the Charter rights to life, security of person and equality of the fetus. The court refused to decide whether the fetus had a right to life under sections 7 and 15 of the Canadian Charter of Rights and Freedoms. As a verdict for the Borowski v. Canada (Attorney General) the court stated that the questions of whether the already unconstitutional section 251 of the Criminal Code violates fetal rights are moot. The Tremblay v. Daigle case had the most interesting and controversial background. 9. Trial So after long eight stages of preparations we are at the most important but not the final stage of the whole criminal case process the trial. The trial is the main stage of any criminal case, it is where all the preparations finally result in a solution and sentence, if the defendant is found guilty. This is where the justice is made. The trial can be divided into six phases. At first a jury is chosen and then the whole process proceeds to opening statements, witness testimony and cross-examination. Cross-examination (which includes witness testimony) is the main part of the whole criminal case process when the evidence is presented, the witnesses testify and the attorneys present their argument. This part is usually closed with closing arguments. After that the jury is instructed in various legal rules concerning the case and the jury proceeds for a discussion and must reach a unanimous verdict if the defendant is guilty or not guilty. Child-Support and Employment Change

Child Support payments in Canada are appointed by the judge and starting from 1997 regulated by federal Child Support Guidelines. The initial appointment of the Child Support payments id divided into four steps. It starts with the calculation of the gross incomes of the parties. The second step is entering the non-custodial parent's gross income is entered into the Table, under the appropriate number of children. It shows the tax free amount of money the non-custodial parent must pay the custodial parent each month for child support. If the parenting time is shared equal then the gross incomes of each parent are entered into the Table. The lower result is then subtracted from the higher number and then the difference is payable by the higher income earner to the lower income earner. Still there are some excepti`ons for some cases. Hit and Run or Failure to Stop at Scene of an Accident

While the crime described in this article is pretty common it still has some controversial sides and in some cases there is a possibility that it was not caused by some criminal intentions. Usually after a motor accident occurs the involved drivers must not leave the crash site, if the driver left for some reason this can be classified as hit-and-run. In the Common Law tradition hit-and-run is the crime of injuring or fatally wounding a person (pedestrian, passenger or another driver), or causing damage to personal property (motor vehicle, even a parked vehicle counts) and failing to stop and identify oneself afterwards. Generally traffic rules in all countries require the driver to stop and exchange identification and contact information with any other driver (drivers) involved in the incident. If the accident happened with a parked car or a stationary property, the driver must stop and make a reasonable effort to identify the property owner (leave a notice at the scene or write down the license plate and identify the police) and alert them about the accident.
