         <title>Employers urged to check public liability issues</title>

         <description>It has been revealed that the HSE is warning bosses to check their public liability cover and to make sure health and safety practices are up to standard.

The warning comes after a work accident, when an employee died due to faulty equipment.

The worker, who was collecting waste outside a pub near Eastington, near Aylesbury, was fatally injured when a 1,000-litre recycling bin fell on his head, in May 2004.

It is believed that that a recycling bin fell from the bin hoist on the recycling lorry and landed on his head, killing him.

The refuse company the victim was working for has subsequently been prosecuted by the HSE. At Aylesbury Crown Court, the jury found the firm guilty of breaching sections 2(1) and 3(1) of the Health and Safety at Work etc Act 1974. The firm was fined £130,000 and ordered to pay out costs of £220,000.

         <title>Driver compensated after road accident</title>

         <description>A man has received thousands of pounds in a compensation claim, after faulty brakes on his work van led to the vehicle crashing.

The 46-year-old man had spoken to his employer about checking the van's faulty brakes on three separate occasions, but nothing was done about it.

In June 2009, his brakes failed and he crashed into the back of another car as he was driving the van back to the depot in Dalston.

The man, who is a local government highway response driver for the firm, was left with whiplash injuries.

The employer's response to the crash was not to check the brakes but to discipline him for crashing the van.

It was at this point that the man decided to ignore the firm's procedures and asked the company fitter to look at the brakes himself. It was found that two of the discs had completely seized and that was the cause of the crash.

Faulty discs leads to injuries

Despite it being illegal to use a non hands-free mobile phone whilst driving, 12 per cent of motorists surveyed said that they have done this in the previous month and 11 per cent admitted that they have sent text messages whilst driving.

This trend is also supported by recent research by the Transport Research Laboratory, which revealed that more drivers are using hand-held mobile phones than before tougher penalties were introduced two years ago.

Reports of more phone usage while driving

         <description>A recent study has indicated that people in the UK place more value on their electric gadgets than on themselves.

People living in Britain have been found more likely to take out insurance cover on their electrical goods and home contents, than they are to protect themselves, according to an independent research study that has been conducted on behalf of a life insurance provider.

With Christmas now in the past and all the presents opened, the average contents value of a home increases. With this increase, it has been noted that as many as five out of seven - 71per cent - Britons included in the survey, have contents insurance on their properties.

Cover for gadgets

Twenty-three per cent of the respondents have insurance against an electrical appliance breaking down. However, this is in huge contrast to the number of people who have certain types of personal protection.

         <title>Car collision victim receives compensation</title>

         <description>After a rear-end car collision, a female motorist is entitled to receive over Â£4,000 in compensation.

The 45-year-old driver, from Southampton, was on her way to visit her elderly mother who she cared for, when the car accident happened.

She was travelling along the motorway when her Peugeot 306 was suddenly shunted from behind by a Ford Focus, thus causing her to sustain personal injuries in the car accident.

So whilst a quarter of us would prefer to leave money for loved ones in our later years, only 16 per cent of us want to receive it.

The UK insurance provider Aviva, has stated that the average bill if you cause a crash in Germany is Â£2,940, which is more than 50 per cent above the average bill, if you crash your car anywhere else in Europe (Â£1,918). British travellers also need to be especially cautious of French drivers, as the average personal injury claim is close to Â£10,000 coming in at Â£9,510.

Costly road accidents on the Continent

         <description>The Penrose inquiry took place recently to look into the supply of contaminated blood and blood products by Scotland NHS. The products were supplied to haemophiliacs and other patients in the 1970s and 1980s. Over 4,000 people across the UK are thought to have contracted diseases, such as hepatitis C in this way, where 2,000 have since died.

         <description>A woman has received compensation of more than Â£20,000 in a personal injury claim after she fell and broke a bone in her wrist, after tripping on a pavement.

The claimant, who is a "very fit and active elderly lady", had been walking along her local high street, which had a wide pavement that was built with square modern paving slabs. As she made her way along the high street, she caught her toe and a raised slab and fell to the floor. 

She naturally put her hands out to break her fall and as a result fractured the scaphoid bone in her wrist. This injury is very common following this sort of accident as the bone takes the full weight of the body as you fall.

The claimant was then taken to hospital and her arm was put in plaster. She was asked to revisit the fracture clinic after 6 weeks and also told to rest at home.

         <description>More than three quarters of vehicles, which have been stopped during safety checks in England and Wales were found to be loaded in an unsafe; putting motorists and loading staff at risk of having a car accident.

These findings were revealed after officials from the Health and Safety Executive (HSE) and the Vehicle Operator Services Agency (VOSA), stopped 40 vehicles during three days of checks in locations across England and Wales.

Although the majority needed remedial action to make the load safe for onward travel and unloading, in most cases, drivers were able to solve the problem safely within minutes. Its success has prompted further checks to be made. 

During the last three years, 14 people have died and more than 2,000 people have been injured by cargo that has fallen from vehicles when they are being loaded or unloaded. 

Load safety can lower risk of accidents

Marcia Davies, Head of Injury Reduction at HSE, said: "Although this was a relatively small number of checks the proportion of vehicles with a problem is alarming.
