         <title>Victim Designations Frequently are in Error</title>

         <description>The term "victim" is one of those words that evoke instant emotions in rational human beings. We like to think of ourselves as empathetic, caring and responsible citizens. We all want to provide services, care, medical treatment, financial support and legal assistance to those people we label as victims.

There are millions of dollars and innumerable jobs associated with the "industry" of being a "victim" in today's modern criminal justice arena. Most law enforcement agencies, prosecutor's offices and state agencies have "victims" advocates, counselors and ombudsmen assigned to work with victims. Now, these are not people that have been deemed victims in any court of law. Rather, they are people that have been so designated by law enforcement or social service agencies.

We want to help legitimate crime victims. Most people have a stereotypical ideal of a "victim" in their mind. The problem is, to each of us, the term victim means something different. 

Reality has a way of being messy and not conforming to pre-conceived notions or definitions. Don't believe me?          <description>"Who do I interview first?" is the thought that runs through the mind of every first responder at incident scenes. Fire fighters, paramedics, security officers and law enforcement officers are all expected to manage a scene upon their arrival, make critical decisions and formulate an approach to handling the situation.

Responders must act quickly in evaluating a situation, isolating the involved parties, deciding the involvement of each person and initiating a field interview. These 4 interviewing decision steps will aid the first responder in that evaluation.

Step 1:Scene Information

First, we need to use background information, dispatch information and scene evaluations to process the scene mentally.

It is at this stage where the responder must triage the scene and all involved persons; that is, decide who needs immediate attention, who can wait and who can be identified for later follow-up.

Step 2: Initial Veracity Assessment

First responders must separate and identify the involved persons from passers-by and other curious onlookers.
	
Once separated from each other at the scene, the responder must observe them behaviorally when no applied stress is involved.          <title>How to Interview a Sex Offender</title>

         <description>The case information was pretty weak, with no evidence at all. 

A 13 year old girl had disclosed to her school counselor that her step-father was "touching her" inappropriately and making her feel nervous.

The counselor reported the allegation to Health & Welfare authorities, who notified the county Sheriff's office that had jurisdiction in the small mountain community.

The Sheriff assigned the case to one of his top investigators, a veteran who had worked many child abuse cases in her career. When the Sheriff's Investigator met with the involved parents of the young girl, the hostility was tremendous. The stepfather yelled and screamed, the mother continually said her husband couldn't or wouldn't do such a thing and the investigator was ultimately asked to leave their house.

The Sheriff's Deputy, acting in concert with a Health & Welfare caseworker, declared the girl in imminent danger and removed her from her home, along with three younger children, pending the outcome of the investigation.

I get mad when I see training advertisements touting the latest and greatest confrontational style interviewing method. I get seriously pissed. Why? Because it's a bunch of horse manure and the people that advertise and promote the training know it too. 

They make a lot of money promoting this old-fashioned interview style but it's not nearly as effective as their exaggerated claims and they know it!

Have you ever gone to an interview and interrogation class and heard the instructor talk about the "sure fire" method he or she was promoting? 

Supposedly, it was a virtual slam-dunk, right? Just follow these "steps" or guidelines in the prescribed format and the result was certain to lead to a confession. Step 1, then Step 2, then Step 3, and so on and so on...always leads to a confession, right? WRONG!!

Well, I've left those seminars too, all fired up and ready to impress the world with my new-found knowledge.          <title>Using Contrast in the Interview Process</title>

         <description>Recently, I interviewed a man accused of stabbing another individual. The circumstances involved drinking, an altercation and a woman who was the object of two men's affection.

Witness statements were unreliable (as usual) because most people don't actually see an event until they hear a commotion, then they look to see what's going on. By asking others what happened, hearing people talk and just by a process of logical deduction, most witnesses then swear that they observed an event. It's kind of like a traffic accident - how many people hear the crash, then look up at the aftermath, but swear they witnessed the wreck?

In this case, one guy (the suspect) was dancing with a girl. The dancing became slow and sensual, which infuriated the girl's date (the victim), who was watching the couple dance.

Words became pushes, pushes became punches and then the victim slumped over holding his stomach - the victim of a stabbing.

The suspect was apprehended by bouncers right inside the bar, but the knife was found on the dance floor, so this case had some big holes in it.          <title>Debunking the False Confession Syndrome</title>

         <description>We hear a lot about false confessions and the "false confession syndrome" in the media. Indeed, there is even a Ph.D. (or two) who makes his living trying to convince the American public that suspects are "made" to confess falsely with a high degree of frequency.

I think it's funny that the case studies people use to make their point about false confessions are all 5-12 years old! If this phenomena was as pervasive as the critics claim, why aren't there cases we can study which are 2 or 3 weeks old?

When I actually study the "false confession" cases referenced, I find that they all have one thing in common: these are false admission cases, not false confession cases. What's the difference?

An admission is an acknowledgment to the asked question, a mere positive indicator. For instance, if an interviewer repeatedly asks a suspect if they committed the crime in question and the suspect finally says "Yeah" that is an admission, not a confession.

         <title>Interviewing People with Mental Disabilities</title>

         <description>This week, I was asked to "quality control" an interview conducted by a police detective who had secured a "confession" from a suspect.

The attorney who retained me said that his client was Developmentally Delayed, had been in Special Education classes throughout school and could barely function independently in society.

He had been accused of stealing a wallet and supposedly had confessed. The client's parents (who still function as his guardians) didn't believe he committed the crime and were suspicious of the confession.

The bizarre part of this case is the fact that the elements of the crime were met by the prosecution: all that is except for intent. The suspect had been caught leaving a Men's restroom at a department store clutching another man's wallet. Store security watched as the suspect left the store, still with wallet in hand. He was apprehended in the parking lot and the police were called.

I got suspicious of the confession when the state didn't want to turn the recording over during discovery. 1. Postage Stamps: Yes, it is possible to get a discount on postage stamps! A lot of times companies or individuals will purchase a mass quantity of stamps for a mailing and end up not using them all. The USPS doesn't buy back stamps, so a good alternative is to sell them on eBay. Expect to pay between 80% and 90% of face value, with the bigger discount coming from a larger purchase quantity.

         <description>Recently, a friend asked me to help her brother sell his collection on Lladro glass figurines on eBay. These are expensive glass collectibles and I knew nothing about them - but I don't have to. The principles for selling expensive collectibles on eBay are the same, regardless of what is being sold. 

Obviously, like any eBay auction, the seller must have a powerful listing with great pictures. This is always true regardless of what the merchandise is. Expensive collectibles offer splendid opportunities, but also need special precautions. 

1. Price: decide the lowest amount you will accept for each figurine and set that price as a reserve. Then make your opening bid absurdly low - yes, absurdly. 

Example: if you will accept $1,000 - make your opening bid $25. There is no risk in this, because you don't have to sell unless the bidding reaches $1000, but the low price attracts buyers, (assuming there is demand, of course). 

Looking at completed eBay auctions allows us to track prices. Again and again we learn that starting the price where the seller hopes it will end is not a wise tactic.
