Real Life Cases Of Premises Liability: How A Slip And Fall Accident Can Happen To You

By:

Slip and fall accidents can happen anytime, anywhere, but did you ever think it was not your own clumsiness at fault but that of the owner of the property? Though many slip and fall lawsuits evoke more of an I cant believe it! reaction, they also tend to hit home because the situations and conditions are so mundane and can happen every day. These examples of settlements for slip and fall or premises liability lawsuits show that falling down is a serious matter.

In October of 2008, a jury in Los Angeles awarded $1 million settlement to a 19-year-old male who slipped and fell on an oil spill in his apartment buildings stairway. This man also suffered from a rare and severe form of hemophilia. Due to his disease he suffered internal bleeding which required long, drawn out attempts to stop the bleeding, including expensive injections of a medicine. The oil spill was caused by someone tossing an uncapped bottle of motor oil down the stairs. The apartment building manager was informed of the oil spill but failed to clean it up. Several witnesses supported the plaintiffs case.

In October of 2007, a jury in Miami awarded $915,000 to a woman who slipped and fell inside a Winn Dixie grocery store. She was shopping near the dairy case when an employee dropped a gallon of juice on the floor. The lady fell and suffered a herniated disc. Several operations later, she is now confined to a wheelchair and her eyesight is starting to fail. The incident occurred several years prior to 2007, but it took that long for the case to be settled.

A slip and fall in the lobby of an office building caused one woman to suffer an acute ankle sprain that was later found to be damaged ligaments and ankle bone fracture. The woman developed reflex sympathetic dystrophy and has been suffering from severe, prolonged pain. The injuries prevented her from working. She filed a lawsuit against the building management for failing to take care of the slippery floor of the entrance of the building where she fell. It turned out that spot was notorious and several other people had noticed the slippery spot, or even fallen in the exact same location. A jury awarded the woman $2.75 million.
