Questions To Ask Your Estate Planning Attorney

By:

Choosing an estate planning attorney isnt as simple as picking one out of the phone book. There are a number of questions you should be asking first to ensure that the attorney you choose can help you create the right estate plan for you.

The first thing youll want to know for example, is how much experience your prospective attorney has. Not that a new attorney doesnt know something about drafting Wills but an experience attorney will be able to help you create a trust, advanced directives and any other documents you might need. The more experienced your attorney is, the more likely they can also help you coordinate your estate plan with your retirement plan and financial goals.

Youll also want to ask your attorney about the type of plan they recommend for you because a good attorney wont answer that question right away. First, theyll want to know more about your goals, your finances and your estate. Asking this question is a good way to tell if your attorney really knows their stuff.

You should also ask about a maintenance plan. This ensures that your estate plan is always up to date. With a maintenance plan, youll receive regular reminders to come in and review your plan with your attorney. During the review, he or she will ask you about new marriages, divorces, births, deaths and any other major changes in your life. Without regular updating, your estate plan could become out of date and be challenged by family members after youre gone.

What about price?

You definitely want to talk about fee structure but know this: a one-size-fits-all Will is not for you. Every estate is different and while you should expect your attorney to be able to give you some prices, your cost should be based upon your needs, not the average Will written for the average guy. A good attorney will likely save price for last so that they can give you an accurate estimate of your costs.
