Positivism Or Natural Law

By:

To comprehensively research all the aspect of law and all it's intricate principles, one needs to have a pretty solid foundation of at least a broad range of legal matters, not to mention a keen intellect. Sharp philosophical arguments and debates have been erupting over the many part of natural law for hundreds of years.

Compiling many different views, we now have what is considered "modern law." Noteworthy are perhaps the two biggest contributors to today's structure of law - positivism and natural law, along with all the various thoughts and views spawned from each. Although varying quite noticeably regarding the application of certain laws in some situations, through study and debate these two philosophies have contributed a great deal of relevance to the way we look at modern law.

Although the classifications of natural law and positivism are frequently used, it is important to remember that they cover a very wide range of academic opinion. Even within each camp, there are those veering towards more liberal or more conservative understandings, and there is also naturally a grey area. Having said that, academics and philosophers can be enveloped by one of the categories on the basis of certain fundamental principles within their writings and opinions.

Ultra-human principles have always been tied to natural law, meaning that it's basis understanding of how law works is founded mainly on moral or spiritual principles. For example, in order for a society to have the power to govern, natural law believers insist that to prove the very existence of law itself, it must be based in sound morality. Unfortunately, extremists have taken it too far and rationalized chaos in any such system of social order and structure.

For this reason, natural law theories have been used to justify anarchy and disorder at ground level. This had lead to widespread criticism of the natural law principles, which have had to be refined and developed to fit with modern thinking. On the flip side, natural law has been used as a definitive method of serving 'justice' to war criminals and former-dictators after their reign.
