Personal Injury Claims For Defective Products

By:

Every year defective products are the cause of customers contacting their solicitors to talk about a personal injury claim. When you buy a product from a company you expect it to both conform to regulations and not to perform in a way which may harm you or another person who is using. This, however, is not always the case.

There are a wide variety of different personal injury claims which have been successful resulting from a defective product. Some of the most common claims arise from cars catching fire or suddenly stopping, an exploding electrical appliance and walking aids such as crutches or sticks that snap and break. The latter can usually be very serious and long lasting if you were using a walking aid in the first place there is usually already an underlying injury.

You may well be entitled to compensation from the manufacturer if you have suffered a personal injury from a product, the incident was not your fault and was due to a defect or fault with the product to cover any financial loss after your injury.

If you have been injured by a defective product there are certain procedures you should adhere to increase the chance of a successful claim. Firstly it is important to should seek medical attention as soon as possible after the incident, if the injury does not warrant any kind of treatment it is doubtful that your claim will be successful. Seeing a medical professional shortly after your injury will confirm that the accident was caused by the product and having a record of the incident on record will certainly strengthen your case.

You should also keep the defective product and dont do anything which could damage the product further this may mean that it is impossible to assess why and how the incident occurred. Often people try to figure this out themselves and may try to take the product apart to see why the fault took place which is not a good idea as they may destroy any evidence necessary for the case and the manufacturer may claim that you caused the fault yourself rather than a default. As well as keeping the product in its state after the incident you should also take pictures of it, if there is any more evidence you can collect it will only increase your chance of a successful claim.
