No Car Insurance Accident

If you have been involved in a road traffic accident and have suffered an injury - such as a whiplash injury - you may be considering making a claim for compensation. However, what happens if the driver of the other vehicle was not insured? Can you still make a claim and, if so, how do you go about doing so? You may be feeling anxious and distressed about how long it will take you to recover from your injuries and if you perceive the fact that the third party driver does not have insurance as an obstacle to making a claim, this may put you off making an initial enquiry. However, this article looks at how you can still make a claim if the third party driver was uninsured and how the claims process works in general.

The good news is that if you have been involved in an accident with an uninsured driver all is not lost. There is an organisation called the Motor Insurers Bureau which was set up to help victims of accidents caused by uninsured (and untraced) drivers. When all measures have been carried out to confirm that the third party does not have insurance, the Motor Insurers Bureau will act as the insurers of the third party driver. All insurance companies are members of the Motor Insurance Bureau (they have to be by law) and they help contribute to the costs of running the organisation and also to the money paid out to victims. The Motor Insurance Bureau was set up over sixty years ago and has helped thousands of victims of accidents caused by uninsured drivers.

If your accident was caused by an uninsured driver the claims process will take exactly the same course as if you were dealing with the insurers of an insured driver. Liability will be discussed and debated between the parties representatives and, hopefully, will not be an issue. Your solicitor will arrange for you to be seen by an independent medical expert who will assess your injuries and prepare a report giving a prognosis of when you are likely to recover. Your solicitor will also ask you for details of any out of pocket expenses you have incurred as a result of the accident and will summarise these in a schedule. The schedule of losses and the medical report will then be sent to the Motor Insurers Bureau and your solicitor will begin settlement negotiations with them.

Do not be put off making a claim for injury compensation if you have been the victim of an accident caused by an uninsured driver. The Motor Insurers Bureau was set up precisely to help people in this position and if you have been injured through no fault of your own, you deserve to be compensated.
