New York State has now had true No-Fault Divorce grounds on the books for over one year, and the verdict is in. The new grounds are wildly popular with divorce filers who wish to keep their divorces simple and uncontested. There still must be a plaintiff and defendant in the divorce action, but the defendant is not to blame or is not at fault with these new divorce grounds.

Basically, if using the No-Fault Divorce grounds, the Plaintiff in the Divorce is stating that there has been an irretrievable breakdown in the marital relationship for at least six months. For many people, these new grounds provide the all-encompassing and blameless language for them to begin divorce proceedings immediately and dispense with the hassle of filing for a Legal Separation Agreement first. The new grounds are saving divorce filers time and money by not having to pay for a Legal Separation Agreement and then waiting one year from the date of signing to begin divorce proceedings.

If there is real estate involved, the executor must direct that an Executor's Deed be prepared and filed to transfer ownership of any of the decedent's real estate to the rightful heirs. For the People can assist with the preparation of Executor's and/or Administrator's Deeds.
The executor or administrator will also be required to transfer ownership of any bank accounts, stocks, bonds, mutual funds or money market accounts by working with the agents and representatives from the financial institutions that house or manage such accounts. Any property that has a title to it can be transferred to the beneficiary by creating and signing a new title document that establishes the new ownership. And finally, the executor must transfer remaining property that has no title or formal documents for ownership attached to them either with a notice of assignment or simply by handing over the assets to the named beneficiaries.

Also, because the grounds are purposefully vague, they will work for couples under a variety of different situations. For example, divorces using the No-Fault grounds have been granted even if the couple still resides in the same household or even if the couple has been married for less than one year.
New York State is no longer the only state in the US to not have a true No-Fault Divorce option, and now that we have it, the court system will see much pent-up demand from the public seeking this type of divorce.
