Mib Claims - Uninsured And Untraced Drivers

By:

The Motor Insurance Bureau ("MIB") is a non-profitable organization which was established in 1946 to compensate victims of uninsured and untraced motorists. Under the Road Traffic Act 1988, all Insurance companies are obliged to be members of the MIB and contribute to its funding each year by means of a levy. There is one office in England based in Milton Keynes and the MIB employs almost 320 employees who deal with uninsured and untraced motorist claims all over the Country.

It is a legal requirement for motorists to stop at the scene of an accident and to exchange insurance details with each party involved. However, whilst the majority of motorists do stop, there is still a large number who don't and drive away at the scene. This is most commonly known as a "hit and run" accident. It can be very dangerous and not advisable to drive after a vehicle which has driven off at the scene, and it is more than likely that either the vehicle will have no insurance, or the driver will be uninsured. Nevertheless, providing the accident is reported to the police and you have sustained personal injury as a result of the accident, you may be entitled to claim compensation from the MIB. However, it is important to note that if the vehicle was insured but the driver was not a named driver on the insurance policy, the MIB will not deal with the claim!

If you are ever involved in a hit and run accident where the driver cannot be traced, it is essential that you report the accident to the police as soon as possible and take down details of any witnesses who were present at the scene. You must also visit your GP or attend hospital for any injuries which you may have sustained. It is important to note that injuries which appear to be minor at the time of the accident may cause problems in the future so it is always important to seek medical attention for even the most minor injuries.
It is surprising how many people are unaware that they are able to claim personal injury compensation under the MIB scheme. The scheme not only includes motorists, but pedestrians who may have been knocked down by an untraced or uninsured driver.
