K-1 Visas From Vietnam, Cambodia, And Thailand

The United States K-1 fiancee visa is a much coveted travel document amongst bi-national couples originating in Thailand, Cambodia (sometimes colloquially referred to as Kampuchea), and Vietnam. This type of visa is often utilized by those wishing to travel to the USA for the purpose of entering into a marriage.

The process generally begins at the United States Citizenship and Immigration Service (USCIS). This organization is tasked with adjudicating United States immigration petitions. Those unfamiliar with the United States visa process may find it notable that the adjudication of a K-1 visa application by a US Mission abroad (US Embassy, US Consulate, American Institute, etc) can only commence after the initial adjudication and approval of a US visa petition at USCIS.

The American State Department's National Visa Center (NVC) also plays a part in the K-1 fiance visa process. However, their role in this process is dramatically curtailed when compared to the NVC's role in the Immigrant visa process. During the Immigrant visa process, the National Visa Center is responsible for gathering a great deal of relevant documentation. Whereas, in the K-1 visa process, the NVC is effectively relegated to the role of clearinghouse in that the agency's primary responsibility is to ensure that visa application packages arrive at the correct US Embassy or US Consulate abroad.

The K-1 visa process is basically the same for those seeking visas on behalf of a Vietnamese, Cambodian, or Thai fiancee. That stated, Vietnam is somewhat unique in that most immigrant visas and K-1 visas are processed out of the US Consulate in Ho Chi Minh City rather than at the US Embassy in Hanoi. In most cases, immigrant visas are processed out of an Embassy exclusively or out of both an Embassy and a Consulate in a given jurisdiction, but this is not always in the case when it comes to Vietnam.

The US K1 visa process can be a difficult endeavor for individuals who are not accustomed to interfacing with the United States bureaucracy. As of the time of this writing, obtaining a K-1 fiance visa requires efforts from multiple United States agencies under the authority of two different Federal Departments. Therefore, some couples opt to retain the assistance of American counsel trained and experienced in matters pertaining to United States immigration. Those thinking about hiring an American attorney for such endeavors are encouraged to verify the credentials of those claiming qualification in such matters as only an American attorney licensed in at least one jurisdiction is permitted to engage in the acceptance of fees in exchange for the practice of American immigration law pursuant to 8 CFR 292.1.
