Instances Of Medical Malpractice - Legal Matters And Examples For Information

By:

Medical malpractice describes instances in which a medical professional neglects to perform his or her job to standard practice. Consequently, that neglect causes a serious bodily injury to a patient or the death of the patient in the medical professional's care. Medical malpractice lawsuits can be filed against a doctor, nurse, hospital or any other type of medical personnel. There are different types of medical malpractice, including but not limited birth injury, elder abuse, surgical mistakes, medication error, or hospital mix-up.

One example of a medical malpractice case would be the people suing medical manufactures for failing to provide medical professional with a warning regarding the dangers of placing pain pumps in the shoulder joint. When placed directly in the joint a condition called postarthroscopic glenohumeral chrondrolysis, or PAGCL, can develop. This condition can cause permanent deterioration of cartilage and chronic pain.

Another example of a medical malpractice lawsuit would include cases in which people are misdiagnosed by hospital personnel. For instance, in one such case a woman was complaining of leg pain and was given an ultrasound to check for blood clots. The technician that performed the test failed to notice the blood clot in the womans leg. The clot ultimately killed the woman and for this reason her family sued the technician and the hospital for medical malpractice.

Birth injuries often lead to medical malpractice lawsuits. One of the most common type of medical malpractice cases in this area would be those involving children who develop cerebral palsy as a result of a doctors negligence. For instance, in one such cases a OB/GYN failed to order a necessary c-section before lack of oxygen to the baby caused damage and cerebral palsy. The c-section was ultimately performed at the urging of another physician on staff at the time of the delivery.
