Injury Lawyer Reminds That Some Lawsuits Take Time

By:

I came across this article in the Wall Street Journal and thought it was a good launching point for a conversation about the lengths of lawsuits. This specific article, "Chevron Turns Tables on Ecuador Plaintiffs; Sues Them" by Ashby Jones, talks about the fact that Chevron is turning the tables. However, I wanted to pull out the part that states that this lawsuit has been an "18-year-old legal battle." With that said I want to remind you that some cases can take a while to prove.

Why Do They Take So Long?

There is not a specific answer for this, but it is safe to say that the legal process itself takes time. There is a specific order to how a case is run and you have to wait for certain things to happen before the case can progress. For example, with worker's compensation cases you continuously have to gather information from doctors. It can take a good deal of time to get the doctors to fill out the proper information and send it over. Then you are most likely going to have to get a second opinion and wait for them to send the results. This example is part of the gathering stage of a case, but each stage has its holdups.

Everybody Thinks They Are Right

Remember, both sides think they are right. The only reason that there is a case is because both sides feel that they are right. As an injury lawyer, I know that we may acknowledge the other side's opinion, but to represent our clients, we must believe and prove that our client is right. Because both sides feel they are right, it takes a lot to come to an agreement.

Patience Is Important

Lastly, as an injury lawyer I want to remind you to be patient. There will be many times when the opposition may offer to settle the case. Sometimes these offers are fair and worth it, but they are often far less than what you could get if you waited. Your injury lawyer will help you determine if an offer is reasonable.

The bottom line is that if you are involved with a legal case or about to start one, you need to remember that these cases can take time. The legal process is not something that can be fast-tracked. There are rules and processes that must be followed to ensure that you get the proper settlement. If you are concerned or have questions about the lengths of a legal case then you should contact an experienced injury lawyer today.
