No Win No Fee is acontingent fee (in the United States) or conditional fee (in England and Wales) where the solicitor's services are only paid if your claim is successful. Initially when the case was won the lawyer would be paid by deducing a percentage from the compensation or by the claimant where a fixed fee would have been prearranged beforehand.
On the first of April 2000, the Access to Justice Act 1999 (section twenty seven) amended the Courts and Legal Services Act 1990 to permit the lawyers fee to be deducted from the losing party.
To make it easy, if the lawyer you're working with operates on No Win No Fee basis you dont pay a penny whether or not you win or lose your case.
The benefit of No Win No Fee is that it guarantees the claimant that the lawyer would be giving all the required attention to win the case since the service fee will only be paid off the losing party only if the case is successful. On the other hand one would possibly argue that solicitors wouldnt be honest in creating the choice whether or not to represent the claimant or not. Since the service fee is only paid if the case is won, the lawyer may not handle the personal injury compensation claim if the case doesn't seem to be favourable.
Many law corporations use lead management corporations to qualify a claim before they tackle the case. Claims management corporations help claimants to nurture their case by helping them acquire necessary documents to form a personal injury claim, provided that the claims management company was ready to help the client nurture their claim, they will pass on the case to the law firm where a solicitor can handle it.
There are many injury compensation claims management companies however it is important to make sure that the company is regulated by the Ministry of Justice. A qualified claims management company regulated by the ministry of justice can follow all the principles and rules to make sure they provide a sensible and truthful service to all or any who are looking to create a claim.
Some law firms take the term "No Win No Fee" quite literal where they'd charge you a service fee if you win the case, which means that you have to either pay the solicitor or deduce the service fee from the compensation amount. Make positive to discuss the No Win No Fee basis together with your lawyer before you persue your claim.
