How To Draft An Eviction Notice?

You are a lucky landlord if you have good tenants all the time. Getting a hefty amount in the form of lease is no doubt a straightforward profit for you. But sometimes you may have difficult times in dealing with unruly tenants who either does not pay any rent or violates the lease seriously. Then you are left with no other option except giving him an eviction notice. This article tells you how to prepare your own notice, without paying money to the attorney.

Before you draft the notice, it is better to consult the local state laws regarding the rules for evicting the tenant. Though the laws are common in many aspects, each state has specific laws and stipulations for different areas. So, you should be thorough with the state laws before finalizing the notice.

Know the time frame to be given for the tenant for rectifying the violation. In case you are not able to decide the timeframe consult the local courthouse which will guide you through the process. In case of non payment of rent the time given is less than a week. In other cases, time may extend up to 30 days also, if you wish to terminate the lease before the stipulated period.

Decide your next move before issuing the eviction notice to the tenant. If you feel still the tenant is reasonable man, who can back pay the rent in full within the given time, you can wait for some time. But if you strongly feel that the tenant is quite unruly in behavior and has seriously violated the norms of lease, then plan your next action. You must be ready to approach police or the court for vacating him if the tenant is not taking your notice seriously.

Draft the notice in simple way. Use straight-forward language and do not be ambiguous anywhere in the letter. Ensure you sign the document and enter the date on it. You can be liberal in relaxing the date if the tenant requests you for some more time for repaying the rent. You can be human if you feel the tenant is honest and genuine.

Ensure that the eviction notice is hand delivered to the tenant and decide your action plan depending on the move of the tenant.
