What counts right now is who you purchased your car from. If you bought from a big dealership, one that uses GMAC or some other well known, national finance corporation, you have some leeway. They do not automatically repossess a car at the drop of a payment.

Unfortunately, the smaller the dealer, the more quickly they want the vehicle. They cannot spread the risk over a network and they need the cash flow right now. But, if you do not ask, they cannot say yes. And fifty percent is a pretty good bet. Better than nothing.

They can come onto your property without prior notice and remove your car without warning. The restrictions against them doing that can differ from state to state. But generally they have the law on their side.

Since they can act without warning, it is in your best interest to seek them out first. You can tell if they are open to negotiation right away. You will not find them to be quite as flexible as they were when they first saw you.

If you are fortunate and can get a little breathing room then be sure that whatever you have negotiated is in writing and not on a handshake. You might want to arrive with your idea in writing and a small payment to show you mean to get right with the loan.

If the dealer is not interested in what you have to offer, expect the car to be repossessed. As long as your property or your person is not harmed, the car repossession law is on their side. But at least you have tried.
