Heirs Have A Right To View A Will

By:

If you have been named as heir in someones will you have the right to view that will. In addition to having the right to view the will, you also have the right to all of the information concerning the assets in the will, as well as their distribution. It is also common for some personal possessions to be distributed prior to the settling of the will at the close of probate proceedings. This is important to keep in mind just in case the executor of the will wants to deny you access to any of the personal belongings that were left to you or others.

This problem is most common in families where the executor of the will is a relative and there is some type of dispute within the family. Regardless of any dispute that you may have with family members, you still have the right to view a will where you are named as beneficiary, or a will that it would be expected that you would be named as beneficiary, such as the will of a parent or spouse.

In most cases there are several laws in place to protect the beneficiaries named in a will that is going through probate. If you are named in a will and any of the assets in the will are subject to probate proceedings, you should receive notification of this.

Additional rights as beneficiary include the right to ask that the executor of the will file it with the probate court. If that person refuses you can have the court order that this be done. If you have to take legal action before the person files the will with the court, you are then entitled to reimbursement for your legal fees.

If you are in the situation where a loved one has passed and you are named in the will, you have a right to see that will. If the executor of the will is withholding this document from you, it is a good idea to contact an estate-planning attorney for assistance.

It is important to note that although you will have the right to look at the will after someone dies, you do not have any legal right to view the will while the person is still alive.
