Handling An Abandoned Rental Property

Rental home investment is not all milk and honey. Sometimes things happen to go sour causing financial loss for the investor and incurring legal proceedings, losing more money along the way. However, landlord insurance and property management can soften the blow. The insurance can go a long way to covering money losses and court costs and property management have legal know how in handling defaulting tenants and abandoned rental properties. All issues are handled with professional skill, relieving the owner of worry and saving him time by taking care of court appearances and serving notices.

Despite the most stringent screening, there is always the possibility of someone slipping through the system, gaining a rental lease and looking like a saint while nothing could be further from the truth. For cases like these, they cause problems to property management and contribute stress to landlords. When approached regarding rent owed the tenant is abusive and not at all apologetic as they should be. Sometimes the property is vandalized in retaliation and then they conveniently disappear with rent still owing as well as leaving a big damage bill.

Until the property has been declared legally abandoned the landlord is unable to rent it out again resulting in more lost income. This is a big stress as not only is rent still owing, but there will be no income until it is legally declared abandoned. The tenants notice of entry must first be issued by the landlord or by the property management Point Cook office. Within 24 hours notice, the issued paper should then be placed where it can easily be found by the tenant upon his/her return. If no reply is given to the notice, the landlord or property manager has the right to enter the property, validate abandonment and check for possible damages. If abandonment is believed to have taken place, they can then issue the tenant with a notice of abandonment termination or apply to a Tribunal in order to have it declared abandoned.

If after seven days there has been no opposition to the notice the lease is declared finished and any repairs can be made to allow it to be made ready for further tenancy. The tenant can make a claim for compensation in the case of their not having been time to dispute the notice, but this must be done within 28 days. It is not always the case that an abandoned rental equates to property damages, but the fact that the tenant has left the property without due notice already signifies some form of loss for the landlord. Having landlord insurance is the best way of minimizing losses due to damage and lost rental fees.
