Business owners located in the Go Zone areas may find that the Employee Retention Credit is very beneficial to their companies

Though the nations desire is to repair/rebuild the hurricane destroyed areas such as Alabama, Florida, Louisiana, Mississippi and Texas from the 2005 hurricanes-Katrina, Rita and Wilma is noble, the Business Owners located in the Go Zone areas do not understand how many benefits they may be entitled to, and they are left not knowing how to pick up the pieces.

The question was answered by The Go Zone Act of 2005, by letting companies that were doing business prior to the devastating hurricanes to claim the "Employee Retention Credit." With this benefit a qualified employer can receive as much as a 40% of each employees annual income, as long as it does not exceed the cap of $6000.00, incurred or paid before January 1, 2006. Note this benefit is only available to companies that were made inoperable (or lost the better part of their business) after the devastating hurricanes and up until the company resumes most of his business back. This means: Employers that had no payroll expenses or that suffered little to no damage is not eligible to receive this benefit.

The cut- off dates for employers to claim any and all income paid or earned in the Go Zone regions are different for each area: For example; Rita Go Zones cut off date is September 23, 2005 or after, Katrina Go Zone areas cut off date is August 28, 2005 or after, and Wilma Go Zone areas cut off date is October 23, 2005 or after.

Please know that both the employer and the employee have certain requirements they must abide by to be eligible for credits under the "Employee Retention Credit." The employee still may qualify for credits even if they were not at work (sick leave, holiday leave, vacation leave), or not working at the principal place of business. For instance if a New York based business had a subsidiary office in a Go Zone region, the wages paid to the employees at the subsidiary location of business may be eligible for the benefit.

There are substantial tax benefits that employers that were actively doing business in the Go Zone regions, before the hurricanes of 2005, may be eligible for. These benefits would greatly reduce the tax liability dollar for dollar.

Although business owners that were in business prior the tragic hurricanes of 2005, have a unique opportunity to begin their own rebuilding and keeping there fiscal head above water. Also through the "Employee Retention Credit and the Go Zone Act employees are assured job security and business owners are less burdened with payroll demands. It is still extremely crucial for rebuilding and attracting new development into the Go Zone areas.
