Texas child labor laws include provisions that protect the health and well-being of children in the workforce. In Texas, a child is defined as anyone under the age of eighteen, and only in certain cases are children under the age of fourteen allowed to be employed. There are exemptions if the child is employed by or supervised by a parent in their place of business, but in no case is a child under the age of fourteen or fifteen allowed to do manufacturing, mining, operate power equipment, operate motor vehicles, act as a public messenger, transport people or property, work in a boiler room, be responsible for repair or maintenance of equipment, do outside window washing that requires elevation of any kind, cook, bake, work in freezers or meat coolers or load or unload goods from trucks, railcars or conveyor belts. In general, children are not allowed to be employed in any hazardous occupations, in the agricultural industry or other, which are deemed dangerous.

Under Federal law, children ages fourteen or fifteen may not work during school hours, but under Texas law, children may not work between the hours of 10 p.m. and 5 a.m. on a day followed by a school day. In this case, the stricter of the laws applies, in order to protect the youth.

All businesses which employee children in the state of Texas must post Texas labor law posters in common areas for easy viewing, in order to be in compliance. For businesses that violate any of the laws contained herein, the State considers those violations as misdemeanors and can assess penalty fees up to ten thousand dollars.

It is imperative that any child working in the state of Texas or otherwise understand their rights and protections under the law. Although these laws must be posted on labor law posters, they should also be explained through the hiring process by the employer or even a parent.
