Faulty Lights? Who Is To Blame For A Car Accident?

The Daily Journal reported earlier this month on a two-car accident in which a woman was injured and a vehicle ended up in the front yard of a resident who then called 911. According to the resident, Don Harris, this is not the first time a car has ended up on his property.

Harris maintains that the traffic light is not functioning properly and is the cause of the tire tracks and broken glass that seem to always litter his front yard. He claims that the light changes are too quick and says that he and neighbors have contacted city officials to ascertain if something can be done. The city claims that they were not aware of any problem. However, the municipal engineer did volunteer to check the settings of the traffic light if residents think that it is not calibrated correctly.

The Journal article raises an interesting question when it comes to car accident liability: Can there be fault that is not attributable to any of the drivers involved? If Mr. Harris is correct in his assessment of the traffic signal in question, the answer is clearly, yes. Of course, this brings up the question of whether or not a city can be held accountable for accidents caused by traffic signals that have not been properly calibrated. The answer to this question is not so obvious; however, if the city knew that there was a problem and did nothing to correct it, it would seem that it does bear some degree of liability.
