With piracy rates increasing, and people resorting to unscrupulous means, there have been several defective products launched in the U.S market off late. So, let's look at the requirements of the Michigan Defective Product Law in order to claim for a defect in the concerned product.

In broader terms, the defect may be based on several backgrounds, such as negligent design of the product, Negligent manufacturing of the product, negligent failure to warn about a particular aspect of the product, breach of an express or implied warranty, and last but not the least, misrepresentation or fraud about the product.

As per the Michigan Product law, if an individual suffers adverse affects of a product, then he or she must be able to prove the following points in order to claim for compensations. Firstly, it must be proved that the product was defective by any of the ways that are mentioned above, and that the defect is a potential threat that can cause complication one could suffer loss or injury from. Finally, it must be proven that an injury or damage was actually sustained.

Negligent Design happens to be the root cause of majority of product defect claims, and it has more to do with design issues during the manufacturing phase, which had potential issues to actually cause the damage to the consumer/end user.

In one of the classic cases, 414 Michigan 413, Owens v. Allis-Chalmers Corp, 326 NW2d 372 in the year 1982, the 2-pronged standard was adopted to assess manufacturing defects, and same has been adopted by Michigan Legislature since the year 1996.

The Negligent Manufacture as well as the Negligent Failure to Warn cases, also include similar issues, and the Michigan product liability law also keeps the door wide open for consumers to report against inherently dangerous products. As a result, it becomes the duty of manufacturer to warn the users of possibilities of adverse affects, and the necessary care that must be exercise while using such products. By doing so, companies that manufacture goods will be able to avoid liability from any potential lawsuits from defective products.
