If you are in arrears on your loan payments during the holidays, creditors do not care. Creditors will sue over the holidays. It may have been your intention to pay your bill, but you simply ran into financial problems. Well on that point, your creditor may not care but an Ontario Small Claims Court judge may have a different opinion.

If someone has filed an Ontario Small Claims Court plaintiffs claim against you, you have 20 days to file a Defence. Some people dont file a defence because they know they owe the money and the reason that they didnt pay was purely personal or financial. Others have disputes over the amount that they owe.

An Ontario Small Claims defence has provisions in it where you can indicate that:
-You dispute the entire amount claimed
-You dispute part of the amount claimed
-You admit the amount claimed

Then you can propose a repayment plan on the amount that you admit you owe. After filing your defence forms, you will receive a notice from the Ontario Small Claims Court notifying you of the date and time that you will have to attend a pre-trial/settlement conference.

At this meeting you and the other side will negotiate with the mediation of an Ontario Small Claims court judge, deputy judge or referee. Here you can explain your difficulties and if successful, could bind a court appointed settlement and repayment plan at this meeting.
