The BIS considers an EMCP a mitigating factor, with great weight, in determining administrative penalties in case of an export violation.

Olga Torres, Ms. Torres is an international trade attorney with the law firm of Braumiller Schulz LLP. She assists clients in complying with U.S. regulatory regimes governing international business transactions; ITAR and EAR export controls, licensing, commodity jurisdiction, classification, country sanctions, and technology transfers. Ms. Torres also assists with associated enforcement actions, including conducting internal investigations, preparing voluntary disclosures, and responding to penalty notices.

She also represents clients in Customs and Border Protection matters, including customs rulings, classification, focused assessments, C-TPAT and associated enforcement actions including investigations and fines, penalties and forfeiture procedures. She has also assisted clients in proceedings before the U.S. Department of Commerce, including antidumping and countervailing duty scope ruling requests. Other aspects of Ms. Torres' trade practice include counseling clients on the commercial impact of antidumping and countervailing duties.
