Typically a product liability lawsuit is filed by a customer who has been injured by a defective product. In most product liability cases, the injured party will file a claim against the party who designed the product, the manufacturer, and/or the vendor that sold or distributed the product. The most common product liability claims involve defective design or an improper manufacturing process.

In a defective design product liability lawsuit, the injured party needs to prove that there was a design flaw that caused the product to be defective. This would mean that every product that comes off the assembly line carries the same inherent defect.

If there is a manufacturing defect, this means that the design was sound, but the product is not being manufactured or built according to the original design. It comes down to how the product is being produced at the factory. In this instance, not every product will be defective.

Misrepresentation. In a product liability lawsuit your attorney may claim that the product was misrepresented in some way. This means that because of how the product was advertised or promoted it gives the normal customer a false sense of security and safety about the product.

Strict Liability. Strict liability means that the manufacturer of a product is liable for defects even if the manufacturer was not negligent in making the product defective. Strict liability applies most often in product liability claims involving manufacturing defects.
