Common Problems Associated With Diy Probate

By:

Probate and the legal proceedings that are typically associated with a bereavement can often be an unavoidably lengthy and complicated process. For this reason, it is usually only a small minority of families that opt for DIY probate and attempt to undertake this process on their own. Although DIY probate can be a very attractive prospect for many grieving families who wish to preserve as much of the deceased's estate as possible, this can often be an overwhelming task.

The majority of people who decide to make an attempt at DIY probate usually either have some level of experience in this field, or do so because the administration of the deceased's relatively uncomplicated estate will be a straightforward process. In these situations, the person undertaking DIY probate would not usually be required to undertake any particularly complicated tasks such as the distribution of property or any other problematical financial duties.

Although DIY probate can be an useful option for many, it is recommended that you seek the advice of a trained solicitor if any of following points apply to you:

" the property of the deceased is found to be unregistered

" their estate is found to be subject to inheritance tax

" there is no valid will

" the validity of the will is questioned or the will is liable to be contested

" you are unable to locate all beneficiaries of the deceased's estate

" the estate of the deceased is well over the inheritance tax threshold

The fact remains that in many cases DIY probate can be an extremely stressful task, it must be remembered that this process can take anything from six months to a year, and for many families such a large amount of time and the associated stresses and strains involved can be too much to bear.

When employing professional assistance, any charges that are incurred by a solicitor are usually taken from the estate of the deceased, and for this reason most families who consider DIY probate understandable wish to avoid this cost altogether. However, it must be remembered that the considerable amount of time an effort that is involved with the probate process can take a great deal of time, and anyone attempting to complete the process could lose income if for example they were forced to take time off work to complete the process.

It must also be remembered that without the use of a fully trained legal professional, many families attempting DIY probate could easily make a mistake during the process. It is a sad fact that in the event of such an error the person in question would be held fully liable for any unnecessary expenses that they may have incurred as a result of their mistake. For this reason, many families would consider DIY probate an unacceptably risky procedure.
