Choosing The Right Tax Attorney

By:

Most people struggle with tax issues at one time or another and many of us may not be able to meet our tax obligations in a timely manner. As a result, we may have unfiled or late tax returns, be facing the possibility of collections, or even be charged with fraud or evasion. In such cases as these, it is never a good idea to try to deal with the IRS or state tax commission on our own. If you are dealing with troublesome tax issues that threaten your livelihood or property, you should hire a lawyer to help. Here are some things to look for when choosing a tax attorney.

-- First of all, it is best to find an attorney whose expertise is with taxes and tax law. Although you may really like the family law attorney that you've used for years, not all lawyers are alike; you'll need to work with one who is current on tax law, knows the right people within the system, and who is experienced in helping people navigate tax problems.

Many law offices have different departments that handle different kinds of legal issues instead of just taxes. These are a great place to look for an attorney, since their tax division is sure to have expert lawyers who do nothing else all day long.

-- Ask your family members, friends, and coworkers for recommendations. If you are on intimate terms with someone who may have had tax problems in the past and who has had a good experience with a tax attorney, then that may be a good place to begin your search. Of course, you'll want to check out the lawyer's credentials, background, level of experience, and any other attribute on your own as well.

-- Your candidates should have extensive experience in your particular area of trouble. That area may include, but is definitely not limited to:

Payroll tax recovery
Unfiled and late-filed tax returns
Removal of liens and levies
Compromise agreements
Penalty and interest abatement
Refund and overpayment claims
Criminal tax issues

-- Once you have narrowed your search to a few acceptable candidates, consult with each one and then make a judgment call: only you can ultimately decide whom you trust, whom you feel comfortable with, and whom you think has a good handle on your case and may be able to do the best job for you. The office staff should be prompt and friendly, and should be quick in returning your phone calls and answering any questions you may have.

Choose wisely, and you will feel confident that you are in good hands during a difficult time.
