There is a lot of paperwork that is involved in a child custody case. It is easy for divorcing parents to feel confused and frustrated about what papers they need to fill out for their custody situation. Every state has different laws governing their child custody cases--so there are different forms and papers for every state. However, most states have similar common papers that are required. Here are the most common custody papers that are required for parents to fill out.

The first types of custody papers that the parents need to have are the summons and petition for custody (filed by the parent initiating the custody case) and the response to the petition (filed by the other parent when they receive the summons). Every state has some variation of these types of papers. These are the initial papers for the custody case--they start the court case. Once the first paper has been filed then the other parent has the chance to respond. Most states have a restraining order accompanied with these papers. The restraining order simply says that the parents cannot take the child in the case out of the state without written permission until the case is settled.

After the initial petition for custody, there are forms to fill out about the custody agreement. These are the forms where you decide what type of custody you'd like to have with the child's other parent--joint, sole, etc. You will also have some sort of form where you put in the visitation schedule that you and your ex have worked out. In some states, if you and the child's other parent agree on a schedule then you fill out one set of papers, and if you don't agree then you fill out a different set. There will also be some form where you fill out the holiday schedule for custody.

The last types of general forms are the ones for child support. Both parents fill out the papers about how much income they make, how many expenses, etc. Each state requires different information for these papers, but almost every state has a form about child support.

There are fees when you file your custody papers. If you can't afford to pay the fee, every state has a form you can fill out to waive the fee. Ask the county court about this.

There may be extra forms for your particular case, but most states have forms similar to these. Fortunately, there are also multiple places to get help with your papers. Don't hesitate to ask questions at the court (some courts even have specialists that can meet with you) and you can generally find information about your state online.
