The idea that with the internet and the World Wide Web, you should be able to file your Ontario Small Claims Court forms online makes a whole lot of sense, right?
In Ontario, while you can create your Plaintiffs Claim court forms using some independently owned service, you cannot file your Ontario Small Claims Court forms online. When the time comes to file your Plaintiffs Claim, you can do so by mail.
Other Small Claims Court forms like Affidavits and Motions have to be notarized and so if you want to mail them to the Small Claims Court you will have to visit a notary first. Because the Ontario Small Claims Court Clerks can notarize your Small Claims Court forms many individual chose to file their notarized documents in person as opposed to by mail.
Make sure that if you visit the
Small Claims Court to file your Plaintiffs Claim that you are prepared. You will need to make sure you have completed all of the required forms and have all of your evidence. You will also need to make a photo copy of the forms and evidence as follows:
-One copy for the Small Claims Court
-One copy for you
-One copy for each additional Plaintiff
-One copy for each Defendant
You will also have to pay the Small Claims Court a fee of $75 if you file less than 5
Plaintiffs Claims per/year and $150 if you file 5 or more Plaintiffs Claims per/year.
If you are filing your Affidavit of Service you will have to provide the Small Claims Court with proof that you served the other side.
