Busness Issues In The Context Of Thailand

By:

The following article is meant to act as a sort of primer pertaining to issues associated with business in Thailand, China, the Association of Southeast Asian Nations (ASEAN), and Greater Asia. Those interested in such issues are strongly encouraged to conduct their own research or retain the services of a competent licensed attorney to gain insight and counsel.

Being entrepreneurial in an American, Canadian, Australian, British, or European context is considered by many to be a significant undertaking due to many of the risks inherent in launching a new business. In many ways, the risks can be exponentially higher for those starting a new business in the Kingdom of Thailand. This also holds true for those doing business in any of the many jurisdictions which comprise the Association of Southeast Asian Nations (ASEAN), China; or anywhere in Greater Asia, for that matter. One of the underlying reasons that a venture in Asia may be more risky for a Westerner stems from the fact that Westerners doing business in an Asian context must often adhere to local laws and regulations as well as customs and mores which may be quite foreign to the Western businessperson.

For those seeking information pertaining to legal issues arising in an Asian context it may prove beneficial to retain the assistance of an attorney. Meanwhile, it is often very prudent for prospective businesspersons to research the local customs and practices of those residing in the nation or nations in which one wishes to conduct business. This originates from the fact that a failure to understand basic local customs could lead to a situation in which a business owner unintentionally offends a possible customer or client due to ignorance regarding local societal norms. Another possible problem could arise from a misunderstanding of the practical demands of a given society. For rhetorical purposes, assume that there was a jurisdiction currently in existence on the continent of Asia which had a ban on the wearing of hats. It would seem unlikely that a hat seller would have a great deal of success in such a market. This example is, as a matter of fact, nonsensical; but it elucidates something of greater importance. Namely, that understanding a country culturally is oftentimes as important as understanding her markets and laws.

There are many economic opportunities available for prospective investors in the Kingdom of Thailand and Greater Asia. As the years roll on it seems apparent that the economies of Asia are likely to grow. Hopefully, foreign direct investment on the Asian continent will continue and increase to the benefit of the business community in Asia as well as the Western world.
