For example, a UK company was recently sentenced to a fine of 385,000 under new corporate manslaughter legislation.

Gloucestershire-based Cotswold Geotechnical Holdings Limited was charged with corporate manslaughter after Geologist Alex Wright, 27, from Cheltenham, died at a development site when a trench collapsed on him.

In convicting the company the jury found the companys system of work digging trial pits was wholly and unnecessarily dangerous.

The company ignored industry guidance that prohibited entry into excavations more than 1.2 metres deep, requiring junior employees to enter into and work in unsupported trial pits, typically from 2 to 3.5 metres deep.

The fine is less than the starting point of 500,000 recommended by the Sentencing Guidelines Council (SGC).

The judge said: It may well be that the fine in the terms of its payment will put this company into liquidation. If that is the case it's unfortunate but unavoidable. It's a consequence of the serious breach.

The Corporate Manslaughter Act has increased the level of fines for offences.

Corporations and partnerships are now guilty of corporate manslaughter if the way in which their activities are managed or organised by their senior management.
