Bt Line Engineers Pursue Claims For Noise Induced Hearing Loss

By:

In a number of recent cases for Noise Induced Hearing Loss that have received publicity, it has been established that BT Engineers have sustained hearing loss and/or tinnitus as a result of the use of electronic cable testing equipment supplied by BT. The testing sets included Oscillators, Amplifiers and Headsets and were used by BT engineers, also known as linesmen or jointers, in the tracing, repair and installation of lines within the BT network. The impulse tones generated by the equipment would be heard in the operators headsets and it is this noise that is alleged to have caused injury to BT engineers.

If you have worked for BT using such equipment at any time and you now suffer from symptoms of hearing loss and/or tinnitus, you may be able to pursue a claim for compensation. Hilary Meredith Solicitors are currently representing BT engineers who may have suffered injury as a result of using the tone set equipment. Claims are also being pursued on behalf of BT engineers who have been exposed to loud noise such as in the old strowger telephone exchanges or from working outside close to noisy pneumatic equipment.

Claims have so far been successful where the engineers have used green sets or a combination of the green and yellow sets. BT is currently disputing cases where engineers have only used the yellow only and/or blue sets. However, decisions are awaited in respect of the later yellow or blue sets supplied by BT.

Shane Markham, Head of the Occupational Disease Department at Hilary Meredith Solicitors who specialises in Noise Induced Hearing Loss Claims stated 'these cases demonstrate that BT were negligent and exposed their employees to a risk of damage to their hearing and should have taken steps to prevent exposure to excessive noise in the work place. The Claimants in our cases, as it quite often the situation have been left with hearing loss for which hearing aids may be required which would not necessarily have been needed had their employers taken steps to reduce the noise levels. If you develop an illness which you believe has been caused by your work, you should seek medical advice without delay. If you are diagnosed with an occupational disease you should immediately seek legal advice as strict time limits may apply to your potential claim for personal injury and losses".

It is important to note that you usually only have 3 years from the date of an accident or from the date of diagnosis of the illness/disease to claim compensation for tinnitus and/or Noise Induced Hearing Loss. The majority of Personal Injury claims settle without the need to attend Court; however if Court proceedings are not issued within 3 years of the date of diagnosis of the illness/disease your claim would be statute barred and you would effectively lose the right to claim compensation.

At Hilary Meredith Solicitors we have 23 years experience in pursuing personal injury claims and our dedicated Industrial Disease team can offer expert legal advice in claiming compensation for workplace exposure causing such conditions as Occupational deafness/Noise Induced Hearing Loss and tinnitus (ringing or buzzing in the ears).
