Bacardi Wins Us Havana Ruling

After a nearly 13 year battle, Pernod Ricard lost the lawsuit against Bacardi asking them to stop selling Havana Club branded rum in the United States. The problem lies in that Bacardi sells rum branded as Havana Club within the United States, but Pernod sells it outside the US. Bacardi holds the trademark in US, Croatia, Kyrgyzstan and Tajikistan.

On April 6, the Wilmington, Deleware district court ruled under Judge Sue Robinson that the origin of Bacardis HAVANA CLUB rum is accurate as the bottle states Puerto Rican Rum and is based on the original Cuban recipe created by Jose Arechabala.

Bacardi Cuba company originated in Cuba, but quickly moved to the US after Castro came into rule. Pernod Ricard claims that the Havana Club brand and assets were illegally confiscated by the Cuban government during the revolution in Cuba. Bacardi acquired the recipe and Havana Club brand name from the original owners- the Arechabala family- in 1994.

Pernod Ricard is expected to appeal the latest ruling.
