Additional Inheritance Tax Deductions Permitted In Castilla La Mancha

As in all other countries the development of Spanish law in general has been a result of the peculiarity of it's historical development. As such, while the central government in general reserves ultimate power and responsibility for legislating for the Spanish state, at times the details of many areas of the law are left to the local region to administer.

It may also the case that certain laws are passed by the central government that are pronounced to be valid in all areas unless a regional law has been created that will deal with that particular area of the law.

In the case of Inheritance Laws, Law 29/1987 was passed by the central government to deal with the matter of Inheritance and Gift Taxes. This law has general application across Spain except for Navarra and the Basque Region which have respectively passed their own laws in this area.

While Law 29/1987 has general application it is also important to note that in 2001 the central government devolved total responsibility to the regions for the setting of inheritance tax rates and deductions.

As a result, we must look at both the central and regional laws in order to get an overall picture of the tax deductions that may be availed of in the region of Castilla La Mancha. In effect, the region may decide to extend and improve any deductions that are already available at the state level. Another important point to note is that in order for a person to benefit from any of the regional deductions it may be required that either "" or both - the beneficiary and the testator have been resident in that autonomous community for at least 5 years.

The most important improvements madein Castilla La Mancha are as follows:

Group I and II Relatives

The spouse, descendant or parent of the deceased is entitled to discount 95% of their net tax liability.

Disabled Beneficiaries

Any heir that has a disability that is certified as being to a degree of more than 65% is also entitled to deduct 95% of the value of any inheritance.

All other deductions are as per the State deductions.
