About Product Liability Lawsuits

By:

There are three major types of product liability, all of which may cause injury, damage, or illness to a person. The possible categories include manufacturing defects, design defects, and marketing defects. All three of these problems may result in a consumer bringing a product liability lawsuit against the manufacturer, the supplier, the retailer, or anyone else who may hold responsibility for making the defective product available.

Most states have laws regarding consumer safety that the products sold in that state must meet. If you have been injured, made ill, or been endangered by a product that is defective, you may have cause to bring a product liability lawsuit against either the manufacturer or the supplier.

If you decide to take your case to court and sue someone regarding the product defects, you will have to provide proof of injury, damage, or illness. You can do this by offering medical records of the injury or illness, or records of the damage done. If you have had to pay to have something fixed, have medical attention due to the product, or for any other reason related to the incident, you should provide receipts.

The most common types of lawsuits to be brought against a product have to do with negligence, breach of warranty, and consumer protection. A lawyer can help you figure out which category your lawsuit will fit into. Your lawyer can also answer any questions you have about your case. If you aren't sure whether or not you have a substantial case, your lawyer will be able to look at all your evidence and tell you if you have a good case or not.

Hiring a lawyer who specializes in this type of case will be your best option. You will want to make sure he has a good record of wins in this area, and also get references from some of his other clients. Lawsuits are never easy to go through, but when you have a lawyer who knows the laws in your area, and is familiar with product liability, you will have an easier time understanding it. Sometimes lawsuits are the only way to make sure manufacturers and suppliers remain respectful to public safety issues.
